Powell won't be buried with sons

SALT LAKE CITY (ABC 4 News) - An attorney representing the Cox family says Josh won't be buried in the same cemetery as his two sons.

Attorney Steve Downing tells ABC 4 News that he is awaiting a statement by Josh Powell's mother about the change in plans.

Reportedly, Alina Powell sought to buy a plot next to where Charlie and Braden were buried in Woodline Cemetery.  It created a firestorm Wednesday.  But late Wednesday, Crimestoppers of Tacoma-Pierce County purchased those plots.

Now it appears Josh Powell will not be laid to rest in the same cemetery as his sons.

"We have been led to believe that he will not be buried at Woodline (Cemetery)," Downing says.

Terri Powell, Josh Powell's mother released a statement on the decision.

She said, "We have tried so hard to be loving and considerate and respectful in making Josh’s burial arrangements. We love our little Charlie and Braden and want their resting place to be a place of peace and comfort. We have made the determination that Josh will not be buried at Woodbine Cemetery, but are in the process of making other arrangements. Thank you to all who have so lovingly supported us in this time of inexpressible anguish. Our hearts go out to all of you who – like us – are reeling with shock and grief."

Josh Powell was the main suspect in the suspicious disappearance of his wife Susan in West Valley City, Utah in December of 2009.  Powell went on a late night camping trip with his two sons in wintery conditions and told police Susan was missing when he returned.

Josh moved with the children to a home in Washington state but lost custody to the children's grandparents after police said they found child pornography in the house.  Josh's father, Steven Powell, was charged with possession of child pornography

Josh Powell was ordered to undergo a psycho-sexual evaluation by the judge handling his custody case.  A few days later, he attacked his sons with a hatchet, severely wounding themHe then started a massive fire at his home, killing himself and taking the likes of Charlie and Braden.

Susan Powell has still not been located.  Police have conducted a number of searches in remote areas outside of Salt Lake City but have not located any remains.
